1. How Your Personal Data is Protected?

In accordance with Law No. 6698 KVKK, your personal data shared with www.prefus.com.tr may be processed by us in whole or in part, automatically or non-automatically, by being obtained, recorded, stored, modified, reorganized, or subjected to any kind of transaction on the data, provided that it is part of any data recording system. Any kind of transaction performed on the data within the scope of KVKK is considered as "processing of personal data".

2. Purposes and Legal Grounds for Processing Your Personal Data

The personal data you share is processed in compliance with Law No. 6698 KVKK and related secondary regulations for the following purposes:

• To fulfill the requirements of the services provided to our customers, in line with the contract and technological requirements, and to improve the products and services offered.
• To provide information to prosecutors, courts, and relevant public officials in matters related to public safety and legal disputes, upon request and as required by legislation.
• To offer a wide range of opportunities to our members or share such opportunities with individuals or organizations within the legal framework.
• For analyzing advertising preferences.

3. Information about Third Parties or Organizations Your Personal Data May be Transferred to

For the purposes mentioned above, your personal data may be transferred to individuals/organizations, including our major shareholders, shareholders, advertisers, direct or indirect domestic/foreign subsidiaries, member companies using the www.prefus.com.tr infrastructure, and individuals and organizations related to the services provided.

4. How Your Personal Data is Collected

Your personal data is collected through various channels:

• Information provided through forms on the www.prefus.com.tr website and mobile applications, including but not limited to name, address, phone, work or personal email, and preferences on pages accessed with a username and password, IP records, and cookie data collected by the browser.
• Information obtained from individuals sharing personal data for purposes such as establishing a commercial relationship with www.prefus.com.tr, making a job application, submitting a proposal, etc., through physical or virtual channels, face-to-face or remote, orally or in writing or electronically.
• Data obtained indirectly through various channels, such as websites, blogs, contests, surveys, games, campaigns, and similar (micro) websites, and data obtained from social media platforms (Linkedin, Facebook, Twitter, Google, Instagram, Snapchat, etc.), including publicly shared profiles and data.

5. Personal Data Obtained Before the Effectiveness of KVKK

Since www.prefus.com.tr did not start its publication before the effective date of the KVKK on April 7, 2016, there is no personal data stored before this date. 

6. Transfer of Your Personal Data

Your personal data collected by any of the methods mentioned above may be transferred abroad in accordance with the KVKK and for the purposes of the contract and may be processed or stored in Turkey or abroad. The transfer may be made to service providers abroad who have been accredited by the Personal Data Protection Board and provide sufficient protection for personal data.

Your personal data may be transferred to:

• Business partners with whom collaboration is made for the provision and promotion of products and services.
• Authorized authorities that will determine your location in case of emergency.
• Regulatory and supervisory agencies, courts, and enforcement offices, and other authorized public institutions or organizations that have the right to request personal data.
• Legal entities in commercial relations with www.prefus.com.tr that have your phone number.

The transfer may be made when deemed necessary.

7. Storage and Protection of Personal Data

www.prefus.com.tr is responsible for taking software and physical security measures, such as hash, encryption, transaction records, access management, to prevent the unlawful processing of personal data, prevent unauthorized access, and ensure their storage, in accordance with Article 12 of the KVKK. In case of unauthorized acquisition of personal data by others through illegal means, the situation will be immediately reported to the Personal Data Protection Board in compliance with legal regulations.

8. Keeping Your Personal Data Updated and Accurate

In accordance with Article 4 of the KVKK, www.prefus.com.tr is obliged to keep your personal data accurate and up-to-date. Therefore, members need to share or update their correct and up-to-date data on the website/mobile application to enable www.prefus.com.tr to fulfill its obligations arising from current legislation.

9. Rights of the Personal Data Subject

In accordance with Article 11 of KVKK, the personal data subject has the right to apply to www.prefus.com.tr (data controller) to learn about:

• Whether their personal data are being processed,
• If personal data are processed, to request information regarding this processing,
• The purpose of processing personal data and whether they are used for their intended purposes,
• Third parties to whom personal data are transferred domestically or abroad,
• If personal data are incomplete or incorrectly processed, to request their correction,
• In cases stipulated in Article 7 of KVKK, to request the deletion or destruction of personal data,
• If personal data are corrected, deleted, or destroyed, to request that these actions be notified to third parties to whom the personal data have been transferred,
• To object to a result obtained against themselves through the analysis of processed data exclusively by automated systems,
• If personal data are processed unlawfully, to request compensation for damages suffered.

10. Contact and Application Method

The Data Controller Representative to be appointed by www.prefus.com.tr will be announced in the Data Controllers Registry and on the internet address where this document is located when the legal infrastructure is provided.

www.prefus.com.tr can provide its response, whether positive/negative, to requests, with reasoning and within 30 days, in writing or digitally. The necessary procedures related to requests are free of charge. However, in case any costs are required for the procedures, www.prefus.com.tr reserves the right to request a fee. These fees are determined in accordance with Article 13 of the Law on the Personal Data Protection, by the Personal Data Protection Board.

By sharing your personal data on our website, applications, and other channels, you declare that you accept our Personal Data Policy and the conditions therein regarding processing, processing methods, transfer, sale of data, and other relevant matters, as defined in the Law on the Protection of Personal Data, through explicit consent, which is defined as informed and freely given consent based on specific subject matter, before exercising your legal rights, you will apply to www.prefus.com.tr.
